This type of behaviour, known as landlord harassment, involves intentionally creating conditions that encourage a tenant to break their lease or leave their current residence. It is a specific type of violation that landlords can be held accountable for.
Examples of harassment by the landlord
• Failure to carry out maintenance in a timely and responsible manner
• Withholding amenities that were previously allowed, such as pool privileges or landscaping services
• Reports of inappropriate behaviour that are fabricated or exaggerated
• Notices of inappropriate conduct that relate only to the tenant, while ignoring violations by other tenants
• Refusal to accept or otherwise acknowledge proper payment of rent
• Entering the property without good reason or proper notice, often repeatedly
• Causing a nuisance (e.g., noise or trash) that prevents the tenant from enjoying the rental unit in peace and quiet
• Deliberate destruction of the tenant’s property
• Threatening financial harm, such as reporting to a credit reporting agency or refusing to provide positive references to future landlords
• Physical intimidation and threats of physical violence
Landlord harassment often occurs when landlords feel they cannot wait for reasonable methods to increase rent or not renew leases. Many cases occur in strictly rent-controlled areas where landlords want to get rid of current tenants with lower rents in favour of newer tenants with higher rents.
Landlords who resort to such measures are often trying to avoid the costs of eviction and the hassle of giving proper, legal notice.
Even if the tenant is in breach of the lease or the landlord has decided not to renew the lease when it expires, there is no excuse and no valid reason for landlords to harass tenants.
In this case, you should contact a good civil lawyer and file a case against your landlord. Your landlord at least has to give you a prior notice of one month to leave the house and as you said your lease has another 1 year of validation then she has no right to kick you out.
